Offshore Wind (including transmission)

  • Advising a leading Belgium based marine contractor in relation to its major construction (FIDIC) and supply contracts for five offshore wind farms (in total > 2,000 MW) in German waters, including the assertion/defense of claims/counterclaims arising from BoP, EPCI and T&I contracts against employers as well as from subcontracts with contractors located in and outside Germany.
  • Advising a joint venture between two sector leading companies (Germany and EU based) in two international arbitrations (DIS) against its Germany and EU based foundations suppliers (FIDIC Yellow Book) for a large offshore wind farm in the German exclusive economic zone; claims and counterclaims in relation to 'time' (delay, EoT, prolongation, acceleration), variations/additional work, remeasure, outstanding work and defects (total amount in dispute approx. EUR 200m).
  • Advising a joint venture between two leading Germany and Belgium based contractors in the presentation and negotiations of claims against a Germany based major developer under a EPCI contract (FIDIC Yellow Book) for an offshore wind farm in the Baltic Sea (German exclusive economic zone) as well as in defending against the developer's counterclaims; value of claims and counterclaims approx. EUR 350m
  • Advising a leading Netherlands based marine contractor in relation to various issues around a number of projects, including, for instance, a substantial delay damages claim, in connection with a contract for the installation of subsea cables as well as onshore cables for the connection of offshore wind farms in the Baltic Sea to the German transmission grid.
  • Advising a Netherlands based contractor in relation to various claims (incl. COVID-19 related) arising out of a German law governed contract for critical works for an offshore wind farm in Taiwan.
  • Advising a Norwegian contractor in relation to supply and maintenance contracts for offshore converter platforms in the North Sea.
  • Advising a joint venture consisting of a Dutch contractor and a Chinese cable manufacturer on corporate law issues relating to the establishment of a consortium under German law as well as advising on public procurement law with regard to a possible review procedure for a large offshore grid connection project in the Baltic Sea.
  • Advising a German contractor in relation to the determination of and compensation for bad weather days and associated vessel standby during the identification and removal of UXOs.
  • Advising a joint venture of UK and German energy majors in connection with the drafting and negotiations of all relevant contracts for the construction of two offshore wind farms in the UK with a total capacity of 3 GW.
  • Advising on the drafting and negotiations of the steel fabrication and supply (EPC) contracts for all the foundations of an offshore wind farm in Taiwan (600 MW).

Infrastructure & Energy (outside Offshore Wind)

  • Advising a joint venture between two leading international marine contractors in relation to contracts in connection with the Fehmarnbelt tunnel project; the Fehmarnbelt tunnel project is said to be North Europe’s largest ongoing infrastructure project, with an estimated cost of approx. EUR 7.5bn.
  • Advising a US contractor for engineering, architectural, planning and other construction services on construction contract issues against a German TSO in connection with a major grid expansion project (with a length of 700 kilometres and a transmission capacity of four gigawatts the largest infrastructure project of the energy transition in Germany and the largest underground cable project worldwide).
  • Advising a Spanish-Italian contractor JV during the successful tender process and EPC contract negotiations for two 600 MW gas fired power plants in Germany. These projects play an important role in Germany’s energy transition as they will replace coal fired power plants from 2026 onwards and natural gas is only intended to be used for a transitional period before being replaced by hydrogen.
  • Advising a German utility in connection with the termination of contracts for the supply, construction and commissioning of wind turbines and related foundations, as well as their maintenance due to significant price increases and deviations in technical specifications/defects for four onshore wind projects with a total planned capacity of approx. 250 MW.
  • Advising a major German electricity producer in relation to the procurement (esp. EPC, FIDIC based, and LTSA) of numerous GTCC projects in Germany.
  • Advising an American construction company on implementing a procurement strategy as well as drafting all the relevant subcontracts in relation to the installation of EV charging stations on behalf of a leading energy supplier who seeks to implement its net-zero ambitions with this project.
  • Advising a Spanish contractor on an ongoing basis in relation to issues arising under and in connection with its EPC contract for a CHP project in Germany.
  • Advising various Germany based funders (banks and private equity investors) in the due diligence of project agreements (esp. EPC and O&M) in relation to numerous onshore wind and solar PV project financings (>600 MW).
  • Advising an operator of solar and wind farms on the sale of several solar projects in the UK, including advising on project contracts (EPC and O&M) under German law in the common law environment.
  • Advising a developer and operator of biogas plants in the UK in relation to the enforcement and defence of legal claims arising out of prime contractor agreements with a German contractor as well as the calling of securities.
  • Advising a leading UK based drilling, engineering and technology company on the drafting of contracts under German law for the supply of two drilling rigs.
  • Advising an English operator of a biomass power plant on the assertion of warranty rights against the German supplier of an important plant component.
  • Advising an American subsidiary of a Japanese electronics giant in the assessment, drafting and negotiations of its contracts for the project management, engineering, planning and construction of battery energy storage systems (up to 48 MW) for Germany based projects.
  • Advising a French based major automotive supplier in relation to the development of two ‘captive’ solar systems to be installed at two of their manufacturing facilities in Germany in order to meet their objective to reduce the carbon footprint of their products as well as the emissions generated by their production sites.
  • Advising a German battery storage developer on its procurement strategy, drafting and negotiations of German law governed contracts for the project management, engineering, planning, construction and operation of its several projects in Germany as well as regular construction advise during the execution of the projects.
  • Representing a German battery storage systems developer in ordinary court proceedings against its client in relation to the enforcement of payment claims arising out of a contract for the planning, construction and commissioning of a storage power plant.
  • Advising one of the largest Austrian suppliers of district heating on the conclusion of an energy purchase agreement with a German supplier of thermal energy from a geothermal plant for feeding into the Austrian grid.
  • Advising a leading German contractor in a major international arbitration in London (ICC) against its employer under an EPC contract for an India based coal fired power plant; value in dispute approx. USD 140m.
  • Advising a leading German contractor in a major ad hoc arbitration in India against its employer under an EPC contract for an India based coal fired power plant; value in dispute approx. USD 140.
  • Advising a German engineering group engaged in the engineering, procurement and construction of waste incineration and power plants on the drafting and negotiations of EPC (FIDIC) and supply contracts for various projects in India, including a 450 MW power plant.
  • Advised a leading German electricity producer on the negotiations and execution an O&M contract for a 150 MW power plant in Gujarat (India).
  • Advising a leading utility in relation to contract negotiations for the construction and maintenance of two 100MW/100MWh battery energy storage systems (BESS) for a German power transmission system operator.
  • Advising a Canadian utility on the drafting and negotiations of all relevant contracts (BoP EPC, TSA, MSA) for two onshore wind projects in Romania.
  • Advising a major Chinese construction and civil engineering company with regard to its planned corporate structure in the EU, and potential risks relating to EU-wide regulations to improve mutual access in international procurement (International Procurement Instrument).

Production & Logistics

  • Advising an Italian EPCM contractor on prolongation claims against the German employer in relation to a major special chemicals plant construction project.
  • Advising the Italian subsidiary of a multinational engineering company on various claims in relation to the construction of a major pharmaceutical production plant in Germany.
  • Advising a UK based life science contractor in relation to the procurement strategy and negotiation of numerous construction contracts for various projects in the DACH region.
  • Advising a major UK and Dutch based business in the drafting and negotiations of an EPC contract in relation to the expansion of a manufacturing facility near Mannheim.
  • Advising a UK based life sciences company in relation to the procurement and construction (VOB/B) of its new regional headquarters and logistics centre in Germany.
  • Advising the German subsidiary of a Turkish leading steel industry corporation in relation to construction, labour and commercial matters for its logistics projects in Germany.
  • Advising an American construction company in the drafting and negotiations of a framework agreement for the provision of design services for various projects of a large German energy utility.
  • Advising an automotive supplier on a building demolition contract, in particular in relation to the contractor's liability.
  • Representing the Russian subsidiary of an American construction and engineering company, a global leader in the oil and gas sector, against a Russian subcontractor in a DIS arbitration concerning payment claims allegedly arising from a large and complex chemical plant project in Russia.
  • Representing the Dutch subsidiary of an American construction and engineering company, a global leader in the oil and gas sector, against an Italian subcontractor in a DIS arbitration concerning payment claims allegedly arising from a large and complex chemical plant project in Russia. Following the successful conclusion of the arbitration, we also represented the client in annulment proceedings initiated by the opposing party at the Cologne Higher Regional Court which upheld the arbitral award.
  • Acting as sole arbitrator in a dispute under the DIS rules in relation to the recovery of a loan granted for the production of cutting-edge medical products.
  • Advising a German developer on the drafting and negotiation of various contracts for sustainable real estate projects.
  • Advising a Swiss pharmaceuticals company on its global procurement and contracting strategies for the implementation of production plant projects worldwide.

Hotels & Data Centers

  • Advising a British project developer in connection with various hotel projects in Germany, in particular with regard to the drafting and negotiation of general contractor and subcontractor agreements.
  • Advising a German utility group in relation to the termination and restructuring of numerous commercial contracts in connection with the sale of the client’s stake in a joint venture concerning the construction and operation of data centres in Germany.

Internationalization

  • Advising a large German chemicals manufacturer in an India based commercial litigation involving the extraction of a multi-million EUR deposit.
  • Advising a Germany based telecom major in the termination of an agency agreement and a number of service contracts in India as well as in relation to various claims.
  • Advising an Indian diversified business in the drafting and negotiations of a number of international agency and trade related contracts as well as the presentation of and defence against numerous claims and counterclaims.
  • Advising an Indian textile business in relation to its claims against a large Germany based fashion business.
  • Advising a major German family owned group of companies on the establishment and acquisition of businesses in India.

Impact (outside Renewable Energy)

  • Overseeing the establishment of a Zurich based asset management joint venture between a London and Dubai based bank and a Singapore based investment boutique, engaged in fund management and regulated by the Swiss Financial Market Supervisory Authority, FINMA.
  • Overseeing the setting-up of an open-ended collective investment scheme and various Malta and Mauritius based expert funds.
  • Overseeing the establishment of a Zurich based multi-family office regulated by Polyreg (a self-regulatory body recognised by the Swiss Financial Market Supervisory Authority, FINMA) and focusing on wealth management services for clients in the Middle East.
  • Overseeing the positioning of asset management activities in the area of cleantech and sustainability/impact investing; contributing to the conceptualization and establishment of related private equity investment initiatives and Singapore based asset managers, in part financed by a non recourse grant administered by Spring Singapore, a government agency.
  • Presenting on numerous occasions on issues relevant for impact investments as well as ESG, including customized client workshops.
